The United States District Court for the District of Connecticut, located in New Haven, Connecticut (the "Court"), presides over this Lawsuit, which has been brought by Plaintiff Matthew Adams ("Plaintiff") against Defendant Pall Corporation ("Pall") to recover damages under federal and state law. Plaintiff alleges that Pall suffered or permitted classes of non-exempt manufacturing and production employees working in the states of New York, Maryland, and Connecticut to work during times before the scheduled start of their shift, after the scheduled end of their shift, and also through meal periods but did not pay them for it. As a result, Plaintiff alleges Pall must pay back wages and liquidated damages under the Fair Labor Standards Act ("FLSA") and New York, Maryland, or Connecticut law.
The Court has preliminarily certified three subclasses, for settlement purposes only, defined as follows:
Defendant denies all allegations in the Lawsuit and contends that it has fully complied with the FLSA and the respective laws of New York, Maryland, and Connecticut. The Settlement is not an admission of any wrongdoing by Defendant or an indication that any law was violated. Defendant and the Plaintiff (together, the "Parties") have reached a settlement, as described below, which is subject to Court approval.
